Art licensing is an arrangement where an artist grants permission to a business to use their artwork on products or for marketing purposes. This permission is defined by a legal agreement that outlines how the artwork can be used, for how long, and in what geographical areas. The artist retains ownership of the artwork while the business gains the right to use it under the agreed conditions.
-
This permission comes with a set of rules, agreements and payment, which usually include:
1. How the Art Can Be Used: For example, the artwork might be used on products like textiles, boutique apparel, or in advertisements.
2. Who Can Use the Art: The permission can be exclusive (only one person or company can use the art in the agreed way) or non-exclusive (the artist can give permission to multiple people or companies).
3. How Long the Permission Lasts: The agreement specifies how long the person or company can use the artwork.
4. Where the Art Can Be Used: This defines the areas, such as specific countries or regions, where the artwork can be used.
5. Payment: The artist gets paid, which could be a percentage of sales (called royalties) or a one-time fee (Flat fee).
6. Rules: The agreement will have rules about what the person or company can and cannot do with the artwork to make sure it’s used correctly.

To start the process, contact me and express your interest. We will discuss your intended use for the artwork. We will then negotiate terms and draft a licensing agreement.

The cost can vary widely depending on factors such as the intended use, the scope of the license, and the duration. Costs can include upfront fees (Flat fee), royalties, or a combination of both.
-
Royalty: A percentage of the revenue generated from the products using the licensed artwork.
Upfront fee (Flat Fee): A one-time payment made to the artist for the right to use their artwork.
-
The duration of use is negotiated and specified in the licensing agreement. It can range from a few months to several years, depending on the agreement.
-
Any modifications to the artwork must be clearly defined in the licensing agreement and require the artist’s approval.

Below is a simplified step by step process:
-
STEP 1
You explore my artwork and choose the pieces you would like to use (license). If you find any of my designs elsewhere that catch your eye, please let me know too. If you require any design modifications or adjustments, I am happy to accommodate those requests.
-
STEP 2
After establishing what you need, we will discuss the payment, terms and conditions for our collaboration. I will maintain the copyright to my artwork. You will pay me with a flat fee, or based on royalty - an agreed upon percentage of the gross sales agreed-upon. This payment can be made monthly or quarterly.
-
STEP 3
I will then provide you with the specified files. Once I send the files, you can begin developing your final products. You can showcase products that highlight my artwork, which you can sell wholesale or directly to customers.
-
STEP 4
If you are happy with my work, we can explore further collaborations on upcoming projects, fostering long-lasting partnerships.
